Estate Planning, is the process of putting things into place during your life time whilst deciding what should eventually happen to them when you die or become incapacitated in any way. In most cases people work long and hard for this and it includes everything that belongs to you. We will focus on what assets you currently have and how you anticipate your circumstances potentially changing in the future. Planning in this way enables you to protect what you have by regaining full control over your assets and being able to choose how they work for the benefit of you and your family, both now and in the years to come. You will, of course, want this to happen with the least fuss possible.
As you go through your life there is a need to revisit all your planning at regular intervals.

WILLS: The legal document that brings you protection, organisation and peace of mind. You choose what happens to your inheritance, and you choose the people to carry out your wishes.

  • Not having one is a huge risk that can leave you powerless over what happens to your assets.
  • Your money, possessions and property will be divided according to the law, not you.

TRUSTS: A Trust forms a protective ‘wrapper’ around those assets placed into it, controlled and managed for the beneficiaries (people who receive the gifts). They can:

  • Protect young, vulnerable children.
  • Ensure assets are safeguarded within the family.
  • Help with tax planning.
  • Protect your property for future generations. The Protective Property Trust contains a ‘right to occupy’ clause, meaning the spouse/partner can remain in the property for the rest of their life. It also safeguards the children’s inheritance.

There are many other uses for trusts, but the sooner assets are placed into trust, the more chance you have of protecting wealth further down the line. They offer an excellent level of protection.

INHERITANCE TAX PLANNING: This is the tax payable on all assets such as property, money, and possessions that make up your Estate, that are over and above the threshold each person has. You are taxed at 40% and the threshold is the amount that you are allowed before any tax is deducted. This threshold is rising over the next few years, so early planning is recommended to look at any possible liability and how to deal with it.
